These Terms and Conditions govern your use of our website and your purchase, sale, trade-in or consignment of jewellery with GJS. By browsing our site, placing an order, or sending us jewellery to sell or trade in, you agree to be bound by these terms. Please read them carefully before proceeding, and contact us first if anything is unclear.
1. About GJS
GJS is a specialist retailer of second-hand and pre-owned jewellery. We source items through purchase, trade-in and consignment arrangements with members of the public, and offer them for resale through our website. Because our stock is pre-owned, each item is unique and, once sold, cannot always be replaced with an identical piece.
2. Item Condition, Authenticity and Certification
We describe the condition, materials, hallmarking, gemstone details and any certification for each item to the best of our knowledge and belief, correct at the time of listing. As pre-owned pieces, items may show signs of prior wear consistent with their age, and any such wear will be noted where reasonably apparent.
Photos of each item are taken of the actual piece being sold. We use a combination of photo editing software and AI-based enhancement to improve image quality and clarity, so that photos more accurately reflect the item’s true colour, detail and condition under normal lighting.
If you believe there is a discrepancy between an item’s listed description and its actual condition, authenticity, hallmarking or certification, please contact us as soon as possible so we can investigate. We encourage customers purchasing higher-value items to obtain an independent third-party valuation in addition to any certification we provide. Where an independent valuation identifies a material discrepancy from our stated description or certification, we will provide a full refund, provided you notify us within 30 days of the date of purchase and return the item to us in the condition it was received.
3. Selling, Trading In or Consigning Jewellery to GJS
GJS is a licensed pawnbroker and second-hand dealer. In addition to selling jewellery, we purchase, trade in and accept jewellery on consignment from members of the public, subject to the following:
- You must be the lawful owner of any item you offer to us, or otherwise have full legal authority to sell or consign it, free of any charge, lien, claim or third-party interest.
- By offering an item to GJS, you warrant that it has not been stolen, is not the proceeds of crime, and that you have lawful title to sell it. We reserve the right to decline any item and to request proof of identity or ownership.
- As a licensed pawnbroker and second-hand dealer, we record the details of sellers and the items we purchase. We provide this information to police upon request, in accordance with applicable second-hand dealer and pawnbroking laws in the relevant state or territory.
- Any valuation or offer we provide is at our discretion, based on factors such as metal content, gemstone quality, condition, brand, market demand and current commodity prices, and is not binding until both parties agree and the transaction is completed.
- For consigned items, we will agree with you in advance on the commission or fee payable to GJS, the reserve or minimum sale price (if any), and the timeframe within which we will attempt to sell the item. If the item does not sell within that timeframe, we will contact you to discuss returning the item or adjusting terms.
- Payment for purchased or traded-in items is made by direct bank deposit into an account held in your name, once we are satisfied as to your ownership and identity.
4. Customer Identification (Know Your Customer)
Whenever you sell or trade in jewellery to GJS – including pieces that contain precious metals, gemstones, or both – we always require you to provide photographic identification, such as a driver licence, passport or other government-issued photo ID, regardless of the value of the item. We verify this identification using a Document Verification Service (DVS) and third-party identity lookup providers, as part of our Know Your Customer (KYC) policy, to confirm your identity and help protect both our customers and GJS from fraud and from the sale or purchase of stolen items.
When you buy jewellery from GJS, we may also ask you to provide photographic identification for transactions over $5,000 AUD, as part of the same KYC policy.
By giving us identity documents, whether online or in one of our stores, you confirm that you are authorised to provide the personal details shown in those documents, and you consent to that information being checked against the relevant document issuer or official record holder, including through third-party verification providers such as our DVS provider, for the purpose of confirming your identity.
5. Pricing and Payment
All prices on our website are shown in Australian dollars and, unless stated otherwise, include GST. We take reasonable care to ensure pricing is accurate, but if a pricing error occurs, we will contact you before processing your order and you may choose to proceed at the corrected price or cancel your order. Payment for online purchases must be received in full before an item is dispatched.
6. Orders and Acceptance
Placing an order through our website is an offer by you to purchase an item, which we may accept or decline. Because our stock is one-of-a-kind, an order is only confirmed once we send you an order confirmation. In the rare case that an item sells out or is withdrawn before we can confirm your order, we will notify you and provide a full refund.
7. Delivery and Shipping
We aim to dispatch orders within a reasonable time of payment being received and will provide tracking details where available. Given the value of the goods, jewellery is typically sent using a secure, insured and signature-required delivery method. Risk in an item passes to you on delivery, while title passes once payment has been received in full.
8. Returns, Refunds and Exchanges
You may return an item within 30 days of the date of purchase for a refund, provided the item is returned in the same condition it was received, with any accompanying certification, packaging and tags intact. This 30-day window applies in addition to, and does not limit, any rights you have under the Australian Consumer Law, including your rights in relation to items that are faulty, not fit for purpose, or not as described. Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law.
To arrange a return, please contact us before sending the item back. Refunds will be made using the original payment method once we have received and inspected the returned item.
9. Warranties and Australian Consumer Law
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure, and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.
10. Limitation of Liability
To the extent permitted by law, and subject to the Australian Consumer Law guarantees referred to above, GJS’s liability arising from your use of our website or purchase of our products is limited to the resupply of the goods or services, or the cost of resupply, at our option.
11. Intellectual Property
All content on our website, including images, descriptions, logos and branding, is owned by or licensed to GJS and may not be reproduced or used without our prior written consent.
12. Privacy
We handle personal information, including information collected when you buy, sell or consign jewellery with us, in accordance with our Privacy Policy, which forms part of these terms.
13. Changes to These Terms
We may update these Terms and Conditions from time to time to reflect changes in our business, our legal obligations, or the way we operate. The version in effect at the time of your transaction will apply, and updates will take effect once published on our website.
14. Governing Law
These terms are governed by the laws of Australia and the state or territory in which GJS operates. Any disputes will be subject to the non-exclusive jurisdiction of the courts of that state or territory.
